Welcome to V.ROZZ. These Terms and Conditions ("Terms") govern your access to and use of the V.ROZZ website, platform, content, products, services, and related features (collectively, the "Platform").

By accessing or using V.ROZZ, creating an account, purchasing a subscription, purchasing merchandise, or accessing any content on the Platform, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Platform.

1. About V.ROZZ

​

V.ROZZ is a digital media and community platform focused on surfing, bodyboarding, ocean culture, independent filmmaking, athlete stories, events, photography, video content, and related products and services.

The Platform may include articles, photographs, videos, films, livestreams, event coverage, surf forecasts, merchandise, newsletters, community features, and other content.

2. Eligibility and Accounts

​

You may use the Platform only if you are legally capable of entering into a binding agreement under the laws applicable to you.

Certain features of the Platform may require you to create an account. You are responsible for:

  • Providing accurate and current information;

  • Maintaining the confidentiality of your account credentials;

  • Keeping your account information up to date; and

  • All activity that occurs through your account.

You must notify V.ROZZ promptly if you believe your account has been accessed without authorization.

You may not create an account using false information, impersonate another person, or create an account for another person without authorization.

3. Membership and Subsciptions

​

V.ROZZ may offer free membership as well as one or more paid subscription plans.

Subscription plans may provide access to different features or content as described on the Platform at the time of purchase.

V.ROZZ reserves the right to introduce, modify, suspend, or discontinue subscription plans or particular benefits associated with them.

Paid Subscriptions

If you purchase a paid subscription, you agree to pay the applicable subscription fee displayed at the time of purchase.

Subscription pricing, billing frequency, renewal terms, and any applicable taxes will be presented during the purchase process.

Unless otherwise stated at the time of purchase, paid subscriptions may automatically renew for successive billing periods until cancelled.

You may cancel your subscription according to the cancellation options provided through the Platform or applicable payment provider. Cancellation generally prevents future renewal but does not necessarily provide a refund for the current billing period.

Where required by applicable law, your statutory cancellation, refund, or withdrawal rights will apply.

4. Content Access

​

Certain content may be available only to registered members or subscribers.

Where content is identified as subscriber-only, you must have an active and eligible subscription or membership to access that content.

Access to subscriber content is personal to the account holder and may not be transferred, shared, sold, or sublicensed.

V.ROZZ may change the availability of particular films, videos, livestreams, articles, or other content from time to time.

Some content may be subject to scheduled release dates or times. V.ROZZ does not guarantee that content will always be available at a particular time or for a particular duration.

5. Livestreams and Events

​

V.ROZZ may provide live or recorded coverage of sporting events, competitions, premieres, interviews, and other productions.

Livestream schedules are provided for informational purposes and may change due to circumstances including event schedules, weather, technical issues, production requirements, internet connectivity, or decisions by event organizers and third-party platforms.

V.ROZZ does not guarantee uninterrupted livestream availability.

Recorded livestreams or event content may remain available after an event at V.ROZZ's discretion.

Certain livestreams or event content may be available only to eligible members or subscribers.

6. Films, Videos and Digital Content

​

All films, videos, photographs, articles, graphics, audio, logos, trademarks, designs, and other content made available through V.ROZZ are protected by applicable intellectual-property laws unless otherwise stated.

Content available through the Platform is provided for personal, non-commercial use only.

Unless expressly authorized by V.ROZZ, you may not:

  • Copy, reproduce, download, record, redistribute, or publicly display protected V.ROZZ content;

  • Sell, sublicense, or commercially exploit V.ROZZ content;

  • Share subscriber-only content or account credentials;

  • Circumvent or attempt to circumvent access controls or technical protection measures;

  • Remove copyright, trademark, or other proprietary notices; or

  • Use V.ROZZ content to create competing commercial products or services.

Unauthorized recording, redistribution, or sharing of subscriber-only films, livestreams, or other protected content may result in termination of access and may violate applicable law.

7. User-Generated Content

​

If V.ROZZ allows users to submit comments, photographs, videos, stories, reviews, or other materials ("User Content"), you retain ownership of your User Content.

By submitting User Content to V.ROZZ, you grant V.ROZZ a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to host, reproduce, display, distribute, adapt, and promote that User Content in connection with operating, marketing, and promoting V.ROZZ and its services.

You represent that:

  • You own or have the necessary rights to submit the User Content;

  • Your submission does not infringe another person's intellectual-property, privacy, publicity, or other rights;

  • Your submission does not violate applicable law; and

  • You have obtained any necessary permissions from people appearing in the content.

V.ROZZ may remove User Content that it believes violates these Terms or is otherwise inappropriate for the Platform.

8. Intellectual Property

​

V.ROZZ and its associated names, logos, designs, branding, website materials, original productions, and other proprietary materials are owned by or licensed to V.ROZZ and may be protected by copyright, trademark, and other intellectual-property laws.

Nothing in these Terms grants you ownership of V.ROZZ's intellectual property.

You may not use V.ROZZ's name, logo, branding, or original content without prior written permission, except as permitted by law.

9. Surf Forecasts and Conditions

​

V.ROZZ may provide surf forecasts, wave information, weather information, wind information, swell information, and other environmental data.

This information is provided for informational purposes only and may be obtained from third-party data providers.

Surf and weather conditions can change rapidly, and forecast information may be inaccurate, incomplete, delayed, or unavailable.

V.ROZZ does not guarantee the accuracy, completeness, or reliability of any surf forecast or environmental information.

You are solely responsible for assessing conditions and determining whether it is safe to enter the water.

Surfing, bodyboarding, and other ocean activities involve inherent risks, including serious injury, drowning, and death. You should use appropriate judgment, experience, equipment, and local knowledge and follow applicable safety guidance.

V.ROZZ is not responsible for decisions made based on forecast information provided through the Platform.

10. Merchandise and Purchases

​

V.ROZZ may offer merchandise and other physical products through the Platform.

Product descriptions, images, availability, pricing, and shipping information are provided as accurately as reasonably possible but may occasionally contain errors.

V.ROZZ reserves the right to correct pricing, availability, or product information errors and to cancel orders affected by an obvious error where permitted by applicable law.

Returns, refunds, exchanges, shipping, and other purchase-related matters are subject to the applicable purchase or refund policy presented at the time of sale.

11. Third-Party Services and Links

​

The Platform may contain links to or integrations with third-party websites and services, including video hosting platforms, social media platforms, payment providers, event platforms, and other external services.

Third-party services are governed by their own terms and privacy policies.

V.ROZZ does not control and is not responsible for the availability, accuracy, security, or content of third-party services.

12. Newsletters and Communications

By subscribing to the V.ROZZ newsletter or otherwise opting in to receive communications, you agree that V.ROZZ may send you newsletters, announcements, promotional communications, event information, and other communications related to the Platform.

You may unsubscribe from marketing emails at any time by using the unsubscribe mechanism included in the communication or through available account settings.

Transactional or service-related communications may continue where necessary to operate your account or provide services you have requested.

13. Prohibited Uses

You agree not to use the Platform to:

  • Violate any applicable law or regulation;

  • Infringe the rights of another person;

  • Attempt to gain unauthorized access to accounts, systems, or content;

  • Interfere with the operation or security of the Platform;

  • Introduce malicious software, code, or other harmful material;

  • Scrape, crawl, or systematically extract Platform content without authorization;

  • Circumvent subscription or access restrictions;

  • Share or redistribute subscriber-only content without authorization;

  • Use the Platform for fraudulent or abusive purposes; or

  • Engage in conduct that could reasonably harm V.ROZZ, its users, creators, athletes, partners, or service providers.

14. Account Suspension and Termination

V.ROZZ may suspend or terminate your access to the Platform if you violate these Terms, misuse the Platform, engage in fraudulent or abusive conduct, or otherwise create a risk to V.ROZZ or its users.

V.ROZZ may also discontinue or modify the Platform or any part of it at any time.

Where appropriate and required by applicable law, V.ROZZ may provide notice before terminating access.

Termination does not affect provisions of these Terms that by their nature should survive termination, including intellectual-property rights, limitations of liability, indemnification, and dispute-related provisions.

15. Disclaimers

To the maximum extent permitted by applicable law, the Platform and its content are provided on an "as available" basis.

V.ROZZ does not guarantee that:

  • The Platform will always be available or uninterrupted;

  • Content will always be accurate, complete, or current;

  • Livestreams will be available without interruption;

  • Particular content will remain available indefinitely;

  • The Platform will be free from errors or security vulnerabilities; or

  • The Platform will meet every user's particular requirements.

Nothing in these Terms excludes or limits any rights or protections that cannot legally be excluded or limited under applicable law.

16. Limitation of Liability

​

To the maximum extent permitted by applicable law, V.ROZZ and its owners, employees, contractors, contributors, affiliates, partners, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Platform.

This includes, without limitation, losses arising from interruption of service, loss of data, loss of content, reliance on forecasts, inability to access content, or third-party services.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

17. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless V.ROZZ and its owners, employees, contractors, affiliates, partners, and service providers from claims, liabilities, damages, losses and expenses arising from:

  • Your violation of these Terms;

  • Your misuse of the Platform;

  • Your User Content;

  • Your violation of another person's rights; or

  • Your violation of applicable law.

18. Privacy

Your use of the Platform is also subject to the V.ROZZ Privacy Policy.

The Privacy Policy explains how V.ROZZ collects, uses, stores, and protects personal information.

19. Changes to Theses Terms

V.ROZZ may update these Terms from time to time.

When material changes are made, V.ROZZ may provide notice through the Platform, by email, or by other reasonable means.

The updated Terms will become effective when posted unless a different effective date is stated.

Your continued use of the Platform after the effective date of updated Terms constitutes acceptance of the revised Terms to the extent permitted by applicable law.

20. Governing Law

These Terms and Conditions and your use of the V.ROZZ Platform are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law principles.

To the extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Platform, your account, subscriptions, purchases, or services provided by V.ROZZ shall be subject to the jurisdiction of the state and federal courts located in Miami-Dade County, Florida.

You agree to submit to the personal jurisdiction of such courts for the resolution of disputes covered by this section.

Nothing in these Terms is intended to limit, waive, or exclude any consumer rights or protections that cannot legally be waived under applicable law.

VROZZ Films, LLC reserves the right to seek appropriate legal or equitable remedies in any court of competent jurisdiction where necessary to protect its intellectual property, confidential information, Platform security, or other legitimate business interests.

21. Severability

​

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be modified or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

22. Entire Agreement

​

These Terms, together with the Privacy Policy and any other policies expressly incorporated by reference, constitute the agreement between you and V.ROZZ regarding your use of the Platform, except where additional terms apply to a particular product or service.
